• Has the OWRB issued previous stream water permits to out of state corporations for use of Oklahoma stream water that has “no beneficial use” to Oklahoma residents? (OWRB): The term “beneficial use,” as relating to water law, is a term which means “the use of such quantity of water when reasonable intelligence and diligence are exercised for a lawful purpose and as is economically necessary for that purpose.” Oklahoma Administrative Code 785:20-1-2. When evaluating “beneficial use,” OWRB determines whether the purpose for using the water is lawful, and then how much water is reasonable to fulfill that lawful purpose.
